Customer Responsibility
PLEASE READ CAREFULLY BEFORE PLACING YOUR ORDER
By placing an order for meat or other perishable food products from Chem Free Life LLC ("Seller," "we," "us," or "our"), you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
These terms establish important requirements concerning the receipt, inspection, temperature, storage, handling, thawing, preparation, cooking, and consumption of perishable meat products and, where applicable, the handling and disposal of dry ice used in shipping.
1. PERISHABLE FOOD PRODUCT
All meat products sold by Chem Free Life LLC are perishable foods and must be handled appropriately immediately upon delivery.
We take reasonable measures to properly process, package, refrigerate or freeze, and ship perishable products. However, once a package is delivered to the address provided by the customer, the customer is responsible for promptly receiving, inspecting, temperature-checking, and proper;y storing the products.
Delivery to a residence, business, mailbox service, carrier facility, or other location where the package may remain unattended is made at the customer's direction and risk.
2. CUSTOMER MUST BE AVAILABLE TO RECEIVE THE SHIPMENT
Customer agrees to make reasonable arrangements to ensure that someone is available to receive the shipment promptly after delivery.
Customer should not order perishable meat for delivery to a location where the package may remain outside, in a vehicle, in an unsecured area, or otherwise unrefrigerated for an extended period.
Chem Free Life LLC is not responsible for food safety problems resulting from a customer or other recipient failing to promptly retrieve the package after delivery.
3. INSPECTION IS REQUIRED IMMEDIATELY UPON DELIVERY
Customer must open and inspect the shipment as soon as reasonably possible after delivery.
Customer must:

Inspect the shipping container and packaging for damage, leakage, or other signs of improper handling;
-
Determine whether the meat is frozem partially frozen, or refrigerator-cold;
-
Use an accurate food thermometer to check the temperature of the product when appropriate;
-
Photograph the shipment, packaging, cold packs/dry ice, and product if there is any concern regarding its condition; and
-
Immediately contact Chem Free Life LLC if the shipment does not arrive in an acceptable condition.
USDA guinance state that mail-order perishable meat should arrive frozen, partially frozen, or refrigerator-cold, at 40F or below, when measured with a food thermometer. If perishable food arrives above 40F, USDA advises the recipient to notify the company and not consume the food.
4. TEMPERATURE REQUIREMENT AND NOTICE OF PROBLEM
Customer must notify Chem Free Life LLC within 2 HOURS of delivery if the product temperature is above 40F, or if the customer has any reasonable concern regarding the safety or condition of the product.
The customer must not consume, cook, taste, or otherwise use meat that arrives above 40F unless the Seller specifically instructs the customer to do so after evaluating the circumstances.
The customer should preserve the product, packaging, shipping container, labels, and cold source and should photograph the product and thermometer reading when contacting the Seller.
Failure to notify Seller within the required period may prevent Seller from being able to determine whether a food-safety problem occurred during shipment, after delivery, or as a result of customer handling.
5. FAILURE TO REPORT A PROBLEM
If Customer does not timely inspect the shipment or notify Seller of a temperature or condition problem, Customer assumes responsibility for any subsequent handling, storage, preparation, or consumption of the product, to the maximum extent permitted by applicable law.
Seller cannot reasonably evaluate or control the condition of perishable food after delivery if the customer does not promptly report a problem.
6. DRY ICE SAFETY - IMPORTANT WARNING
SOME SHIPMENTS MAY CONTAIN DRY ICE (SOLID CARBON DIOXIDE). DRY ICE IS EXTREMELY COLD AND CAN CAUSE SERIOUS FROSTBITE OR COLD BURNS. AS DRY ICE WARMS, IT CHANGES DIRECTLY INTO CARBON DIOXIDE GAS. CARBON DIOXIDE GAS CAN ACCUMULATE IN ENCLOSED OR POORLY VENTILATED AREAS AND MAY CAUSE SERIOUS INJURY, UNCONSCIOUSNESS, OR DEATH.
Customer acknowledges and agrees to follow all dry-ice safety instructions contained in these Terms and any warning labels or instructions accompanying the shipment.
A. DO NOT TOUCH DRY ICE WITH BARE HANDS
NEVER HANDLE DRY ICE WITH BARE SKIN
Customer must use appropriate insulated gloves, tongs, or another suitable tool when handling dry ice.
Direct contact with dry ice can cause serious cold burns or frostbite.
If dry ice contacts skin and an injury occurs, seek appropriate medical attention.
B. DO NOT EAT OR CONSUME DRY ICE
NEVER PLACE DRY ICE IN YOUR MOUTH OR OTHERWISE CONSUME IT.
Keep dry ice away from children and pets. Dry ice must be completely gone before the area or container in which it was located is considered free of dry ice.
C. PROVIDE ADEQUATE VENTILATION
Dry ice releases carbon dioxide gas as it sublimates.
OPEN SHIPMENTS CONTAINING DRY ICE IN A WELL-VENTILATED AREA.
Do not intentionally inhale dry-ice vapors or expose yourself to concentrated carbon dioxide gas.
Do not store a shipment containing dry ice in a small, enclosed, or poorly ventilated room.
Carbon dioxide is colorless and odorless and may accumulate without providing an obvious warning.
D. NEVER PLACE DRY ICE IN AN AIRTIGHT CONTAINER
NEVER PLACE DRY ICE IN AN AIRTIGHT, SEALED, OR PRESSURE-RESISTANT CONTAINER.
As dry ice sublimates, it produces carbon dioxide gas. Gas buildup in a sealed container can create dangerous pressure and may cause the container to rupture. Never seal dry ice inside a glass jar, bottle, plastic container, cooler, or other airtight vessel.
E. KEEP DRY ICE AWAY FROM CHILDREN AND PETS
DRY ICE IS NOT A TOY.
Children and pets must not handle or consume dry ice.
Customer is responsible for keeping dry ice and any package containing dry ice away from children, pets, and other individuals who have not been instructed in its safe handling.
F. DO NOT PLACE DRY ICE IN A HOUSEHOLD REFRIGERATOR OR FREEZER
The extremely low temperature of dry ice can damage appliances and create other hazards. The meat should be removed from the shipping container and transferred to an appropriate refrigerator or freezer as soon as reasonably practical after delivery.
G. DO NOT HANDLE DRY ICE IN A CLOSED VEHICLE
Do not intentionally store or transport significant quantities of dry ice in the passenger compartment of a vehicle. Carbon dioxide released by dry ice can accumulate in an enclosed vehicle and create a serious breathing hazard.
H. SAFE DISPOSAL OF DRY ICE
DO NOT PLACE DRY ICE IN A SINK, TOILET, GARBAGE DISPOSAL, OR OTHER CONFINED PLUMBING SYSTEM.
DO NOT PLACE DRY ICE IN A SEALED GARBAGE CONTAINER.
Small quantities of leftover dry ice should be allowed to sublimate naturally in a safe, well-ventilated location away from other people, children, pets, and combustible materials.
Never leave dry ice where another person could unknowingly touch it.
Do not dispose of dry ice in a location where accumulating carbon dioxide could enter a building or other enclosed space.
I. DO NOT SEAL OR REPACKAGE UNUSED DRY ICE
Never place leftover dry ice into an airtight container for later use or storage. Never attempt to store unused dry ice in a sealed container. Allow it to safely sublimate in an appropriate, well-ventilated location.
J. DO NOT ASSUME ALL DRY ICE HAS DISAPPEARED
DO NOT ASSUME THAT ALL DRY ICE HAS SUBLIMATED SIMPLY BECAUSE THE PACKAGE HAS BEEN DELIVERED. Carefully inspect the package before handling its contents. Follow all dry-ice warning labels and instructions included with the shipment.
7. CUSTOMER RESPONSIBILITY FOR DRY ICE
By accepting a shipment containing dry ice, Customer acknowledges that dry ice presents inherent risks, including but not limited to:

Frostbite;
-
Cold burns;
-
Skin or tissue injury;
-
Carbon dioxide exposure;
-
Breathing hazards;
-
Pressure buildup;
-
Container rupture; and
-
Injury resulting from improper handling, storage, transportation, or disposal.
Customer agrees to follow all dry-ice warnings and instructions provided by Seller.
To the maximum extent permitted by applicable law, Customer assumes responsibility for injuries, damages, or losses resulting from Customer's negligent, improper, or unsafe handling, storage, transportation, or disposal of dry ice after delivery.
Nothing in these Terms is intended to waive or limit any liability that cannot legally be waived or limited.
8. IMMEDIATE REFRIGERATION OR FREEZING
Upon receipt, Customer agrees to immediately refrigerate or freeze the meat.
Refrigerated meat must be stored at 40F or below.
If Customer does not intend to use the meat within the USDA-recommended refrigerated storage period applicable to that particular product, Customer should freeze the product promptly.
Customer is responsible for maintaining appropriate refrigerator and freezer temperatures throughout storage.
9. SAFE THAWING
Frozen meat should be thawed safely in accordance with USDA food-safety recommendations. Acceptable methods include:

Thawing in the refrigerator;
-
Thawing in cold water, with appropriate precautions; or
-
Thawing in a microwave when the meat will be coooked immediately afterward.
Meat should not be thawed at room temperature or left on a countertop to thaw.
10. SAFE HANDLING AND CROSS-CONTAMINATION
Customer agrees to handle raw meat in a manner that prevents contamination of other foods, food-contact surfaces, utensils, refrigerators, countertops, and other household surfaces.
Raw meat should be kept separate from ready-to-eat foods.
Customer should was hands, utensils, cutting boards, countertops, and other food-contact surfaces after handling raw meat.
11. SAFE COOKING TEMPERATURES
Customer acknowledges that safe cooking is the customer's responsibility.
A food thermometer should be used to verify that meat reaches the USDA-recommended safe minimum internal temperature.
Unless a different temperature is specifically required for a particular product, USDA recommendations include:
Beef, pork, veal, and lamb steaks, chops and roasts:
145 F, followed by at least a 3-minute rest period
Ground beef, pork, veal, and lamb: 165 F
Customer should not rely solely upon color, appearance, firmness, or the color of juices to determine whether meat is safely cooked. A food thermometer should be used.
12. REFRIGERATION AND TIME-TEMPERATURE CONTROL
Customer agrees not to leave perishable meat at room temperature for an unsafe period.
USDA advises that perishable foods should not remain in the temperature "danger zone" of approximately 40F to 140F for more than 2 hours, or more than 1 hour when the surrounding temperature is above 90F.
Customer is solely responsible for maintaining proper temperature after delivery.
CUSTOMER'S RESPONSIBILITY FOR FOOD SAFETY AFTER DELIVERY
Once the shipment has been delivered, Chem Free Life LLC cannot control:
-
When the customer retrieves the package;
-
The temperature of the customer's refrigerator or freezer;
-
How long the meat remains unrefrigerated;
-
Whether the product is thawed and subsequently refrozen;
-
How the meat is thawed;
-
Whethr cross-contamination occurs;
-
Whether proper hygiene is used when handling the meat;
-
Wthere the meat is cooked to a safe internal temperature; or
-
Whether leftovers are properly refrigerated, stored, reheated, or discarded.
Customer acknowledges that these factors may affect food safety and agrees to follow all applicable food-safety instructions.
12. DO NOT CONSUME QUESTIONABLE PRODUCT
Customer agrees not to taste or consume meat that appears spoiled, contaminated, improperly handled, or that arrives at an unsafe temperature.
The absence of an unpleasant smell, unusual appearance, or other visible warning does not establish that food is safe. Harmful bacteriia cannot necessarily be detected by sight, smell or taste.
14. REQUIRED DOCUMENTATION FOR A DELIVERY COMPLAINT
If Customer believes that a shipment arrived in an unsafe or unacceptable condition, Customer agrees to contact Chem Free Life LLC promptly and provide, when requested:

Order number;
-
Date and time of delivery;
-
Date and time the package was brought into a conditioned space and opened;
-
Date and time of temperature reading;
-
Photographs of the thermometer reading;
-
Photographs of the shipping box and packaging;
-
Photographs of the meat and cold packs/dry ice;
-
A description of the condition of the product; and
-
Any other information reasonably necessary for Seller to investigate the complaint.
Customer agrees to preserve the product and packaging until Seller has had a reasonable opportunity to evaluate the complaint, unless doing so would create a health or safety hazard.
15. CUSTOMER ACKNOWLDEMENT OF FOOD-SAFETY RISKS
Customer understands that consumption of raw or improperly handled or cooked meat can result in food-borne illness.
Customer voluntarily assumes responsibility for following safe food-handling, storage, thawing, preparation, cooking, and serving practices after delivery.
Customer acknowledges that Seller has provided these instructions for the purpose of reducing the risk of food-borne illness and that Customer's failure to follow them may increase the risk of illness or injury.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Seller shall not be responsible for loss, injury, illness, damage, or other claims resulting from:

Failure of Customer or recipient to promptly receive the shipment;

Failure to promptly inspect the shipment;
-
Failure to measure or report an unsafe product temperature;
-
Improper storage or refrigeration after delivery;
-
Improper thawing;
-
Improper handling;
-
Cross-contamination;
-
Failure to cook the product to a safe internal temperature;
-
Consumption of product after Customer knew or reasonably should have known that the product was unsafe;
-
Failure to follow the food-safety instructions provided by Seller; or
-
Any other act or omission occurring after delivery that is outside Seller's reasonable control.
Nothing in these Terms is intended to waive, release, or limit any tight or liability that cannot legally be waived, released, or limited under applicable law.
17. RELEASE AND ASSUMPTION OF RISK
To the maximum extent permitted by applicable law, Customer acknowledges the inherent risks associated with purchasing, transporting, storing, handling, preparing, cooking, and consuming perishable meat products and agrees to follow all applicable food-safety instructions.
Customer accepts responsibility for risks arising from Customer's own handling, storage, preparation, cooking, or consumption of the products after delivery.
18. INDEMNIFICATION
To the maximum extent permitted by applicable law, Customer agrees to indemnify and hold harmless Seller, its owners, employees, agents, and representatives from claims, losses, damages, costs, and expenses arising from Customer's negligent, improper, or unsafe handling, storage, preparation, cooking, or consumption of the products after delivery, or from Customer's failure to follow these Terms and Conditions.
This provision does not apply to the extent a claim is caused by conduct or liability that cannot legally be indemnified or released.
19. EXCLUSIVE REMEDY FOR SHIPPING OR TEMPERATURE PROBLEMS
If Seller determines that a shipment was damaged, lost, improperly delivered, or arrived in an unsafe condition due to circumstances for which the shipper is responsible, Seller may, at its discretion and to the extent permitted by applicable law, provide an appropriate remedy such as replacement, refund, or store credit.
Customer agrees to provide Seller with the information and documentation reasonably necessary to investigate the claim. This could include the return of the product.
20. CARRIER DELAYS AND DELIVERY CONDITIONS
Customer acknowledges that shipping involves third-part carriers and that delays, missed deliveries, weather events, carrier handling, incorrect addresses, inability to access the delivery location, and other circumstances outside Seller's reasonable control may occur.
Customer agrees to provide a complete and accurate delivery address and to make reasonable arrangements to receive perishable shipments promptly.
21. AGREEMENT TO THESE TERMS
By placing and order, checking the applicable acceptance box, or otherwise purchasing products from Seller, Customer acknowledges that Customer has read, understood, and agreed to these Terms & Conditions.
CUSTOMER ACKNOWLEDGES THAT PERISHABLE MEAT REQUIRES IMMEDIATE AND PROPER HANDLING AFTER DELIVERY AND THAT DRY ICE, WHEN USED, PRESENTS ADDITIONAL SAFETY RISKS. CUSTOMER AGREES TO FOLLOW ALL FOOD-SAFETY, TEMPERATURE, STORAGE, HANDLING, COOKING, AND DRY-ICE SAFETY REQUIREMENTS SET FORTH ABOVE.
Unpacking Your Order
Please be mindful when unpacking your order as each box is packed with dry ice to keep it safely frozen. Dry Ice should be handled with care. Always wear protecting gloves if you move the dry ice from its packaging. To dispose of any remaining dry ice place it outside and will evaporate within 24 hours. Keep out of reach of pets and childen.
Saving it for later?
Keep products frozen by placing them straight into your freezer. You will want to enjoy it within 2-3 months for the best taste and texture.
Safe Handling Guidelines
Remember to keep raw meat and poultry separate from each other and other foods. Wash workng surfaces, utensils and hands after touching raw meats. Don't allow cooked meats to stay at room temperature for too long. Refrigerate leftovers immidiately.
